Acceptable Use Policy

The use of our services, connections and platforms is subject to acceptable use at all times.

Our Acceptable Use Policy (AUP) is detailed below.

Introduction

“We” are The Internet Business Ltd, trading as Tibus. “You” are a person or organisation that directly or indirectly uses Tibus Services. 

Our AUP changes from time to time. We maintain the current version of the Tibus AUP at https://www.tibus.com/acceptable-use-policy/. By using our Services, you agree to be bound by the current version of the Tibus AUP.

The types of activity described in this AUP are not designed to be exhaustive. They are illustrative of examples of conduct that Tibus classifies as inappropriate, improper, illegal, or otherwise harmful.

1. General Prohibited Conduct

You will not use our Services to transmit, distribute or store material in a manner that violates any applicable law or regulation; may adversely affect the Services or Users; may expose us to criminal or civil liability; violate, infringe upon or otherwise misappropriate any third party rights, including intellectual property rights, rights of publicity and privacy rights.  

2. Intellectual Property 

You will not use our Services in any manner that would infringe, dilute, misappropriate, or otherwise violate any privacy or other personal rights or any intellectual property rights, including but not limited to, copyrights and laws protecting patents, trademarks, trade secrets or other proprietary information. 

3. Responsibility for Content

3.1  We take absolutely no responsibility for any content created, accessible or delivered on or through our Services. 

3.2  You expressly acknowledge that Tibus does not monitor or exercise any editorial control over content that happens to use Tibus Services in order to be published and that Tibus does not know the substance of any content that any user publishes using Tibus Services. 

3.3  Tibus customers are expressly and solely responsible for any and all content published or made available through the use of Tibus Services. 

4. Inappropriate Content

4.1  You will not use our Services to transmit, distribute or store material that we reasonably determine is inappropriate, obscene, indecent, defamatory, libellous, tortious, threatening, abusive, hateful, or excessively violent. 

4.2  You will also not use our Services to host terrorist-related or threat-related web sites, including sites that advocate human violence.

4.3  You will not use our Services to host sites that advocate or facilitate hate crimes based upon religion, ethnicity, or country of origin.

5. Harmful Content and Harmful Behaviour

5.1 You will not use our Services to transmit, distribute or store material that may be harmful to or interfere with the Services or any third party's networks, systems, Services, or websites. 

5.2   Prohibited harmful content includes, but is not limited to, viruses, worms, or Trojan horses, root kits, password crackers, adware, and key stroke capture programs.

5.3  You shall not use our Services to send bulk commercial advertising, known as “spam".

6. Misrepresentation, Fraudulent and Misleading Content

You will not use our Services to transmit or distribute material containing fraudulent offers for goods or Services, or any advertising or promotional materials that contain false, deceptive, or misleading statements, claims, or representations.This expressly includes misrepresentation, fraudulent or misleading content based on omission or on the provision of only partial information.

7. Security Breaches and Obligations

7.1 You will not violate or attempt to violate the security of the Services or the computers, accounts, or networks of another party, including but not limited to, circumventing the user authentication or security of any host, network or account.  

 7.2 You will not use our Services to cause security breaches or disruptions of Internet communication and/or connectivity. Security breaches include, but are not limited to, accessing data, accounts or systems without authorisation or logging into a server or account that the Customer is not expressly authorised to access.

 7.3 You will not use our Services to plan, co-ordinate, encourage or facilitate any Denial-of-Service attack, whether distributed or not.

 7.4 You will not use our Services to encourage, plan or facilitate other disruptive behaviours such as unsolicited port scans, flood pings, slow packet attacks, packet spoofing and IP spoofing.  

What happens when our AUP is violated? 

1. We may suspend or terminate your Service, where we believe you have violated any element of this AUP.  

2. We will take the most limited action that is reasonably practical in the circumstances, in order to address the violation in question. 

3. We will attempt to notify you via email or via other communication specified through your contract agreement with us. 

4. We may suspend the Service without notice if we become aware of a violation of the AUP that exposes us to criminal or civil liability or that exposes us, our property, or our customers or their property to harm.
